Divorce

It’s not uncommon for divorce to be a stressful experience. It’s also not uncommon for divorces to be filled with complex legal issues. Property division involves determining what assets belong to whom, and whether or not fault was a contributing factor in the breakup of the marriage. Spousal support has to be considered, as does child support and custody. Temporary Orders

Texas is one of six states that do not recognize legal separation prior to divorce. That means a couple that has chosen to divorce almost always secures temporary orders that provide some stability before a final divorce agreement or trial is finalized. These orders address can be agreed  upon in mediation, or decided by the judge in a mini-trial if there is not agreement. The temporary orders are an important first step in any family law case, and create momentum for the case, because they often determine from the outset who stays in the house, how bills are taken care of what the primary residence of children will be, among others.Once these preliminary decisions have been made, (either by agreement or by the judge) and the parties live under this framework for weeks or months) the status quo is hard to change. As a result, the final decree, or final orders in a custody case often look similar to what was originally ordered in the temporary orders.
