Indeed, most courts even require mediation before a hearing on temporary orders will be held in the beginning of the case unless there are issues involving family violence or other extraordinary circumstances where the court must make immediate rulings for the welfare of the parties and there isn’t enough time to schedule and attend mediation before those rulings are made.

In a mediation prior to temporary orders, we will have discussed your monthly financial statements, income, expenses, and if children are involved, possession schedules and their unique needs.

Strategy Development

Finality of Mediation in Texas: Before finalizing any settlement agreement, it is important to understand that Texas law makes a mediated settlement agreement (MSA) nearly impossible to break or revoke. Indeed, if properly executed, and with only a few exceptions, once a MSA is agreed upon, it is non-revocable. This is important and powerful…. Yet, also a bit frightening if you’ve developed buyer’s remorse the next morning. League City Mediation Attorney Rob Musemeche will carefully review the terms and conditions to ensure they accurately reflect the agreements reached and the agreement you want… during mediation. We will ensure that the agreement protects your rights and is consistent with your goals.

Once the MSA is executed, it is usually filed with the court. If for temporary orders, then the attorneys will draft a more formal, full length set of orders that match the MSA and submit the document to the parties and court for review and approval. If the MSA is for a final order, the same procedure is followed. However, the final order will be presented to the court for a final order, and the case will be concluded based upon the agreement that had been reached at mediation. For these reasons, preparation for mediation is akin to preparation for trial. Strategy, documentation, leverage, all of the things that would be of benefit at trial are still at play in the mediation for final. Indeed, a successful result for one party at mediation for “final” is often based upon what the party feels may be the best or worst day in court…. depending upon the information and perception of preparation they see from the other side that day in mediation.
